Terms of Use
ARTICLE 1 – SCOPE
These Terms and Conditions govern the sale of Fine Art photographic prints offered on the website www.marcjulien.com, operated by Marc Julien.
Orders are processed through the Shopify platform.
The production and shipping of artworks may be handled by a professional partner laboratory specialized in Fine Art printing and framing.
Any order implies full acceptance of these Terms and Conditions.
ARTICLE 2 – NATURE OF THE ARTWORKS
The artworks offered for sale are original photographic works printed on museum-quality Fine Art materials using archival pigment inks.
Prints may be available in different finishes:
- print only,
- framed print,
- floater frame,
- acrylic or aluminum mounting.
Each artwork is produced on demand and offered in a limited edition of a maximum of 15 prints across all formats combined.
The artworks may be shipped directly from the partner laboratory responsible for production.
The signed certificate of authenticity, along with the numbering and authentication elements intended to be affixed to the back of the artwork, are sent separately by mail by Marc Julien.
ARTICLE 3 – PRICES
Prices are displayed in the currency corresponding to the visitor’s country or location when this feature is available through Shopify Payments.
The final amount charged is indicated at the time of order confirmation.
Any shipping costs are specified before final validation of the purchase.
Marc Julien reserves the right to modify prices at any time.
Products are invoiced based on the rates in effect at the time the order is confirmed.
ARTICLE 4 – ORDERS AND PAYMENT
Orders are placed online through the Shopify platform.
Payment is made using the secure payment methods offered during checkout (credit card, Shopify Payments, PayPal, or other solutions available depending on the customer’s country).
Payment is due immediately upon ordering.
Production of the artwork begins only after payment has been validated.
Marc Julien reserves the right to cancel or refuse any order in the event of a previous dispute with the customer or a payment issue.
ARTICLE 5 – PRODUCTION AND DELIVERY
The artworks are produced on demand by a professional partner laboratory specialized in Fine Art printing.
Production and shipping times are provided for informational purposes only and may vary depending on:
- the type of finish,
- the selected format,
- the destination country,
- periods of high activity.
Average delivery times are generally between 7 and 14 business days.
The artworks are carefully packaged to ensure optimal protection during transport.
Delivery is made to the address provided by the customer at the time of ordering.
If a package is damaged during delivery, the customer must:
- make reservations with the carrier,
- then contact Marc Julien within 48 hours of receipt, including photographs of the package and the affected product.
Any customs duties, local taxes, or import fees remain the responsibility of the customer.
ARTICLE 6 – RIGHT OF WITHDRAWAL
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made according to the consumer’s specifications or clearly personalized items.
As the artworks are made to order, produced in limited editions, signed, and numbered, they are not eligible for withdrawal or cancellation once the order has been confirmed.
ARTICLE 7 – LEGAL GUARANTEES
Products benefit from the legal guarantees provided under French law, including:
- the legal guarantee of conformity,
- the guarantee against hidden defects.
In the event of a defect, the customer is invited to contact Marc Julien through the website’s contact page.
ARTICLE 8 – LIABILITY
Marc Julien shall not be held liable for:
- temporary interruptions of the website,
- possible technical errors,
- delays attributable to carriers,
- or force majeure events beyond his control.
The photographs displayed on the website are as accurate as possible; however, slight variations in color or rendering may occur depending on screens or materials used.
ARTICLE 9 – MEDIATION
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, the customer may use the following mediation service free of charge:

ARTICLE 10 – APPLICABLE LAW
These General Terms and Conditions are governed by French law.
Any dispute relating to their interpretation or execution shall fall under the jurisdiction of the competent French courts.
ARTICLE 11 – ACCESS AND ACCOUNT
By accepting these Terms of Use, you confirm that you have reached the age of majority in your state or province of residence and that you consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including browsing our online store or purchasing products or services, you may be required to provide certain information such as your email address, billing details, payment information, and shipping address. You represent and warrant that all information provided is accurate, current, and complete, and that you have all necessary rights to provide such information.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You may not transfer, sell, assign, or license your account to any other person.
ARTICLE 12 – OUR PRODUCTS
We have made every effort to display our products and services as accurately as possible in our online store. However, colors and product appearance may differ depending on your device and display settings.
We do not guarantee that the appearance or quality of products or services purchased will exactly match what is displayed online.
All product descriptions are subject to change at any time without notice. We reserve the right to discontinue products or limit quantities on a case-by-case basis.
ARTICLE 13 – SHIPPING AND DELIVERY
We are not responsible for shipping or delivery delays. Delivery times are estimates only and are not guaranteed.
We disclaim all liability for delays caused by carriers, customs procedures, or events beyond our control.
Ownership and risk of loss transfer to you once the products are handed over to the carrier.
ARTICLE 14 – INTELLECTUAL PROPERTY
All content available through the Services, including trademarks, texts, images, graphics, videos, audio content, product reviews, and their arrangement, is the exclusive property of Marc Julien Photographe, its licensors, or affiliates and is protected by intellectual property laws.
You may use the Services solely for personal and non-commercial purposes. You may not reproduce, distribute, modify, publicly display, republish, store, or transmit any material without prior written authorization.
Nothing in these Terms grants you any license or rights to the intellectual property of Marc Julien Photographe, Shopify, or third parties.
ARTICLE 15 – OPTIONAL TOOLS
The Services may provide access to third-party tools that we neither monitor nor control.
Such tools are provided “as is” and “as available” without warranties or endorsements of any kind. Your use of these tools is entirely at your own risk and discretion.
Future features and tools added to the Services shall also be subject to these Terms of Use.
ARTICLE 16 – THIRD-PARTY LINKS
The Services may contain links to third-party websites or resources.
We are not responsible for examining or evaluating third-party content and assume no liability for any third-party materials, websites, products, or services.
Any access to third-party sites is at your own risk.
ARTICLE 17 – RELATIONSHIP WITH SHOPIFY
Marc Julien Photographe uses Shopify to power its online store and Services. However, all purchases are made directly with Marc Julien Photographe.
By using the Services, you acknowledge that Shopify is not responsible for any aspect of transactions between you and Marc Julien Photographe.
You expressly release Shopify and its affiliates from any claims or liabilities arising from purchases made through the store.
ARTICLE 18 – PRIVACY POLICY
All personal information collected through the Services is governed by our Privacy Policy and may also be subject to Shopify’s Privacy Policy.
By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify may collect and process personal data necessary to provide and improve the Services.
ARTICLE 19 – FEEDBACK
If you submit ideas, suggestions, reviews, proposals, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, non-exclusive license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose, including commercial purposes.
You warrant that:
- you own or control all rights to the Feedback,
- your Feedback complies with these Terms,
- and your Feedback does not violate third-party rights.
We reserve the right, but not the obligation, to monitor, edit, or remove content deemed unlawful, offensive, defamatory, obscene, or otherwise objectionable.
ARTICLE 20 – ERRORS, INACCURACIES, AND OMISSIONS
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping costs, delivery times, or availability.
We reserve the right to correct such errors and to modify or update information or cancel orders without prior notice.
ARTICLE 21 – PROHIBITED USES
You may only use the Services for lawful purposes.
You are prohibited from using the Services:
- for unlawful or malicious activities,
- to infringe intellectual property rights,
- to harass, abuse, defame, or discriminate,
- to submit false or misleading information,
- to distribute spam or malicious code,

- or to interfere with the security or functionality of the Services.
We reserve the right to suspend or terminate accounts violating these Terms.

Automated agents, bots, crawlers, or AI systems may only access the Services in compliance with applicable rules and identification requirements.
We reserve the right to technically restrict or block automated access to the Services.

We do not guarantee uninterrupted, secure, or error-free use of the Services.

To the fullest extent permitted by law, Marc Julien Photographe, its affiliates, service providers, licensors, and Shopify shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from your use of the Services or products purchased through them.
ARTICLE 26 – INDEMNIFICATION
You agree to indemnify and hold harmless Marc Julien Photographe, Shopify, and their affiliates from any claims, damages, liabilities, or expenses arising from:
- your breach of these Terms,
- your violation of applicable laws,
- or your misuse of the Services.
ARTICLE 27 – SEVERABILITY
If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
ARTICLE 28 – WAIVER; ENTIRE AGREEMENT
Failure to enforce any right or provision of these Terms shall not constitute a waiver.
These Terms constitute the entire agreement between you and Marc Julien Photographe regarding use of the Services.
ARTICLE 29 – ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without prior written consent.
We may assign these Terms without restriction.
ARTICLE 30 – HEADINGS
Section headings are included for convenience only and do not affect interpretation.
ARTICLE 31 – MODIFICATIONS TO THE TERMS
We reserve the right to update or modify these Terms at any time by posting changes on the website.
Continued use of the Services following modifications constitutes acceptance of the updated Terms.
